1. Introduction

Welcome to my.AMDT, a customer portal provided by AUVESY GmbH ("Company", "we", "us", or "our"). These Terms and Conditions ("Terms") govern your access to and use of the my.AMDT portal (the "Portal"). By accessing or using the Portal, you agree to be bound by these Terms, which are designed to ensure a clear understanding of your rights and obligations when using the services provided through my.AMDT. If you do not agree to these Terms, please do not use the Portal.

2. Applicability

These Terms apply exclusively to all contractual relationships between you ("User" or "contracting party") and AUVESY GmbH concerning the use of my.AMDT and associated services. Any alterations must be agreed upon in writing.

3. Definitions

For the purposes of these Terms, the following definitions shall apply:
User Account: A personal account created by the user to access the Portal.
License: The rights granted to the user to utilize the software and services through the Portal, subject to these Terms.
Confidential Information: Any non-public information disclosed by either party in connection to these Terms that is designated as confidential.

4. User Accounts

4.1. Account Creation: To access certain features of the Portal, users must create a user account, providing accurate and complete registration information.
4.2. Role Assignments: Users may have different roles. Account administrators can manage permissions for other users under their account.
4.3. Account Security: Users are responsible for maintaining the confidentiality of their login credentials and for all activities that occur under their account.
4.4. Invitations: Users can invite others to join the Portal, and new users must accept terms and conditions to establish their accounts.

5. My Products

5.1. The Portal provides users with an overview of all licenses and associated products. Users can access license details, including status, runtime, and download options.
5.2. License Compliance: Users are required to regularly upload usage data, which will be analyzed to ensure license compliance. Compliance statuses are communicated through the Portal, along with any upcoming upload requirements.

6. Download Center

6.1. Users are granted access to download products and documentation based on their role and valid contracts.
6.2. Permissions will be checked against user roles to ensure compliance with licensing agreements, preventing unauthorized access to products.

7. Knowledge Base and eAcademy

7.1. The Portal features a knowledge base with online help resources and editorial articles to assist users in navigating the software.
7.2. Users can also enroll in free and paid courses offered through the eAcademy, designed to further enhance their skills and product knowledge.

8. Support Services

8.1. Users can create and manage support tickets regarding software issues, which will be triaged based on priority levels.
8.2. Tickets are shared across the customer organization, i.e. every myAMDT user has access to all tickets associated to his/her assigned licenses, independent of the ticket creator. This affects both closed and current tickets.
8.2. Communication: Automatic notifications regarding ticket status changes and other relevant updates are sent via the Portal.
8.3. A dedicated support team will address issues based on severity, ensuring timely resolution.

9. Notification Center

The Portal includes a notification center for GDPR-compliant communications concerning account activity, system updates, and other key messages that users need to be aware of. 
9.1. This is an integral part of the myAMDT services. Therefore, there is no option to opt-out of these messages. 
9.2. Users can opt-out of marketing messages at any time

10. Role-Based User Management

10.1. Account administrators have the authority to assign roles and manage access levels for other users.
10.2. Requests for access from new users must be approved or rejected by an account administrator to ensure security and compliance.

11. Data Privacy and Compliance

11.1. AUVESY GmbH is committed to maintaining the privacy of its users. All personal data will be processed according to applicable data protection laws, including GDPR.
11.2. Users must familiarize themselves with our Privacy Policy concerning the collection, use, and protection of personal data.

12. Limitations of Liability

To the fullest extent permitted by law, AUVESY GmbH shall not be liable for any indirect, incidental, or consequential damages arising from or related to your use of the Portal, including, but not limited to, loss of data or business opportunities.

13. Amendments

We reserve the right to modify these Terms at any time. Any changes will be communicated via the Portal, and your continued use signifies your acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Germany, and any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Landau, Germany.

15. Final Provisions

15.1. All amendments to these Terms must be in writing.
15.2. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in effect.
